Intimacy between Cousins is a heated debate on most social Platforms, with Morality, Legality and religious grounds splitting opinions.
While some opinionate having Sexual relations with your Cousin is morally and religiously wrong, the Kenyan law doesn't deem it illegal.
You will not be charged in a court of law, for engaging in sexual relations with a cousin, according to a High Court Ruling.
A High Court judge, making a ruling where a man had appealed the decision by a Magistrate court to convict him of having slept with his cousin, clarified some religious groups allow it and it's legally not outlawed.
The man argued that the girl in question was never allowed to testify and that the court ruled on the matter based on what he heard and had no idea how the two were related or how they arrived at the point of having sex.
High Court Judge James Makau ruled that the Sexual Offences Act of Kenya does not list cousins among the list of a family liable for incest if one found to have had sex with them.
According to the Judge, the National Assembly did not leave out the clause on cousins by intention but by the fact that in some Kenyan communities such as Hindu, relationship, and marriage among cousins is permitted.
“This means it is permissible to have sex with a cousin,” the judge ruled. “My understanding of the said section (Section 20(1) of the Sexual Offences Act) is that if any sexual activity takes place between two cousins, that does not amount to be incest within the meaning of the provisions of the Sexual Offences Act.” he stated.
Intimacy between Cousins, still remains a hotly debated topic in Kenya, despite some claiming they'd be comfortable with the act, majority expressed opposition to the intimacy, on Morality grounds.
