The Sh505 million corruption case against former Migori Governor Okoth Obado is in the process of having the matter settled out of court after the DPP and EACC entered into a plea bargain.

The case has, however, been adjourned after some parties told the court that they have not signed the said agreement.

Trial magistrate Charles Ondieki directed that the matter be mentioned on September 5 for further directions.

Obado is charged alongside his four children and 11 others for embezzlement of funds while he was still a governor

"Some parties who were not signatories to the said agreement need time to do so, so that the matter can be marked as settled," the court was told.

The matter was to be withdrawn today if the parties had finalised the agreement.

In July, the Ethics and Anti-Corruption Commission (EACC), together with the Office of the Director of Public Prosecutions (ODPP), applied for a one-month adjournment to allow for the conclusion of ongoing negotiations aimed at reaching an out-of-court settlement through plea bargains.

The court was informed that the parties are engaged in advanced talks, and more time is needed to finalise the agreements.

The case centres on allegations of financial mismanagement and corruption during Obado's tenure as governor of Migori County.

EACC accuses Obado and several co-defendants of embezzling approximately Sh505 million in public funds through irregular procurement processes and fraudulent transactions.

The charges include abuse of office, money laundering, and conspiracy to commit economic crimes, among others.

The prosecution alleges that the funds were siphoned through companies linked to Obado's associates, with payments made for fictitious goods and services.

The allegations against Obado stem from investigations launched by the EACC in 2018, which uncovered irregularities in Migori County's financial records.

Obado, who served as Migori Governor from 2013 to 2022, has maintained his innocence throughout the proceedings, claiming that the charges are politically motivated.
